The exhaust flap is part of the ABE, which means that if it is removed, the operating permit of the vehicle expires.
The exhaust flap control is used to maintain the noise in the driving conditions relevant to the measurement range. The regulation specifies the speed and speed ranges in which the noise measurement is carried out. Vehicle manufacturers use a trick here; they simply reduce the volume in these ranges by using a flap system to reduce the cross-section inside the exhaust system. Actually cheated, because in the speed and speed ranges irrelevant for the measurement procedure, the original systems are actually too loud.
The replacement pipe offered here replaces this flap control and always releases the entire cross-section. We find that it is in no way too loud, but it is still not permitted in public road traffic.
